Welcome to the terms and conditions (“Terms”) for U-USA Coalition.

These Terms are between you and U-USA A NJ NONPROFIT CORPORATION (“U-USA Coalition” or “Us”) and govern our respective rights and obligations. Please read this Agreement carefully. Please note that your use of the http://www.U-USA.org website (the “Site”) are also governed by the agreements listed and linked to below, as well as all other applicable terms, conditions, limitations, and requirements on the http://www.U-USA.org website, all of which (as changed over time) are incorporated into these Terms.

This Site contains various information relating to U-USA Coalition in the form of text, graphics, news, reports, and other materials (tangible or intangible) (“Content”). By accessing, browsing and/or using this Site you acknowledge that you have read, understood and agree to be legally bound by this Agreement. If you do not accept this Agreement (and therefore do not agree to by bound by this Agreement), do not use this Site. If you become a member of U-USA Coalition, you accept these terms, conditions, limitations and requirements.

You acknowledge that this Site contains Content that is protected by copyrights, trademarks, service marks, trade secrets, patents, or other proprietary rights, and that these rights are valid and protected in all forms, media, and technologies existing now and hereinafter developed. You also acknowledge that the Content is and shall remain the property of U-USA Coalition, or any other party (each a “Contributor”) who has been involved in the preparation or publication of the Content. You shall at no time assert any claims of ownership over any content by reason of your use of or any right to use this Site and shall not grant or create or suffer to exist any lien or other security interest arising therefrom.

You agree to comply with all copyright and trademark laws and you shall not encumber any interest in, or assert any rights to, the Content. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any Content, in whole or in part. You shall not store electronically any significant portion of any Content. U-USA Coalition authorizes you to view and use the Content on this Site solely for your personal, noncommercial use. The use of the Content on any other site, including by linking or framing, or in any networked computer environment for any purpose is prohibited without U-USA Coalition’s prior written approval.

Other Limitations

• We reserve the right to accept or refuse membership in our discretion.
• We may send you email and other communications related to U-USA Coalition and your U-USA Coalition membership.
• You may not transfer or assign your U-USA Coalition membership or any U-USA Coalition benefits, including promotion for U-USA Coalition memberships or benefits, except as allowed in these terms.
• From time to time, U-USA Coalition may choose in its sole discretion to add or remove U-USA Coalition membership benefits.

Agreement Changes

We may in our discretion change these Terms, U-USA Coalition’s Conditions of Use and Privacy Notice, or any aspect of U-USA Coalition membership, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

YOUR CONTINUED MEMBERSHIP AFTER THESE TERMS ARE CHANGED AND/OR AMENDED BY US CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST NOTIFY US WITHIN 72 HOURS OF THE POSTED CHANGES.

Membership Cancellation

You may cancel your membership any time by notifying us in writing (e-mail), and we will remove your pages from our website during 48 hours period.

Termination by Us

We may terminate your membership at our discretion by the 72 hours notice.

Limitation of Liability

UNDER NO CIRCUMSTANCES WILL U-USA COALITION BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR ACTIVITIES, ACTIONS, AND/OR OMISSIONS BY VIRTUE OF THE FACT THAT YOU ARE A MEMBER OF U-USA COALITION. TO THE EXTENT THAT U-USA COALITION IS SUED, IMPLEADED, AND/OR OTHERWISE JOINED TO ANY LAWSUITS, CLAIMS, AND/OR OTHER PROCEEDINGS ARISING FROM YOUR ACTIVITIES, ACTIONS, AND/OR OMISSIONS, YOU AGREE TO INDEMNIFY AND DEFEND U-USA COALITION FROM ANY AND ALL CLAIMS, LAWSUITS, AND/OR OTHER PROCEEDINGS ARISING FROM SAME. UNDER NO CIRCUMSTANCES WILL U-USA COALITION BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON INFORMATION OBTAINED THROUGH THE CONTENT ON THE WEB SITE. IT IS YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION OR ANY CONTENT AVAILABLE THROUGH THE WEB SITE.

IN NO EVENT SHALL U-USA COALITION BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE CONTENT, SERVICE, OR THIS AGREEMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR NEGLIGENCE, CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH JURISDICTIONS U-USA COALITION’S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THIS SITE AND/OR TERMS OF MEMBERSHIP IS TO STOP USING THIS SITE AND CANCEL YOUR MEMBERSHIP.
